PROVISIONAL CONCLUSIONS IN THE TRIAL OF HECTOR RISCART

TO THE FOURTH PENAL CRIMINAL COURT OF THE POPULAR PROVINCIAL TRIBUNE OF HAVANA

THE JUDGE STATES: That in accordance with article 278 of the LPP and deeming complete the proceedings of the EFP 3-826/11 of the Department of Penal Proceedings of the Municipality of Old Havana, following the crime of PRODUCTION, SALE, DEMAND, TRAFFIC, DISTRIBUTION AND POSSESSION OF ILLICIT DRUGS, NARCOTICS, PSYCHOTROPIC SUBSTANCES AND OTHERS OF SIMILAR EFFECT the present and wishing to resolve in accordance with the petitions formulated hereupon:

A: Having the accused HECTOR RISCART MUSTELIER assured with the cautionary measure of PROVISIONAL IMPRISONMENT.

B: Commencing the trial to Oral Judgement, to which effect the following are formulated.

PROVISIONAL CONCLUSIONS

FIRST: On the 16th of November of 2011, at approximately 02:00 hours, the accused in custody HECTOR RISCART MUSTELIER, who was under control of the National Antidrug Management, by virtue of the prior knowledge that the subject was dedicated to the commercialization of the drug known as Marijuana with the aim of increasing in an undue manner its personal gain in his place of residence, dealing with the municipality of Cerro and Central Havana, was detained by the agent of Public Order Maikel Atiet Creagh, who was fully uniformed and carrying out his service as guard and patrol in the area and had received an hour earlier the information on behalf of off-duty agent Ernesto Martinez Ramirez who had seen the accused RISCART MUSTELIER commercializing drugs within the National Cabaret, situated on San Rafael Street between Prado and Consulado, Central Havana, Havana, taking advantage of the musical performance of the Reggae group HERENCIA of which the accused acted as director. That once the accused RISCART MUSTELIER was roaming around the outside of said Cabaret accompanied by citizens Adrian Obregon Janero, German Daniel Rivera Diaz, and Zenen Mario Abreu Peña, exactly at the intersection of Prado and San Jose, Old Havana, Havana, was approached by the aforementioned agent Maikel Atiet who proceeded to ask them for their identifications and to carry out a pat-down search of each one, leaving the accused for last. When it came to the turn of the accused RISCART MUSTELIER after having arrived at the scene police agents Wilbert Durruthy Favier, David Rosseaux Columbie (this last, Chief of Police) the accused turned over his identity card and refused to be bodily searched stating that he preferred to be searched at the Police Unit and not on site since he was an artist, as he walked back and forth taking small steps, thereby causing agents Maikel Atiet and Wilbert Durruthy to react by holding him by the arms whereupon the accused with the purpose of impeding the police action got loose by pulling with his body and managed to free one arm from the hold of said agents with which he nimbly took off his white turban covering his head and his abundant hair worn in the form of Dreadlocks, and flung it to the floor revealing two parcels of transparent white nylon previously bundled in the turban, of which the first contained: three nylon bundles with green colored vegetable cuttings, of these one with a net weight of 0.52 grams, another with 5.48 grams of marijuana, and the last with 1.85 grams of marijuana, and the second parcel with 6 cigarettes with plant cuttings of 0.86 grams of marijuana inside, four of them in white paper and the remaining two in black and white paper, a bundle which contained a total of 11 marijuana seeds with a net weight of 0.21 grams and a nylon bag containing a single dark red and round seed popularly known as OJO DE BUEY (eye of bull), of approximately 5.5 cm in diameter, with a hole in both extremes and remains of ashes in its interior. Proceeding immediately to conduct the accused RISCART MUSTELIER to the police station where he was consequently informed of previously formulated charges for the corresponding accusation, as well as legally confiscating all previously mentioned bundles.

That during the investigation process the two transparent white nylon parcels that were confiscated were submitted to the Central Criminal Laboratory with all of their aforementioned contents, as well as a sample of urine of the accused RISCART MUSTELIER and after being subjected to chemical studies, it was concluded that the samples of plant cuttings in the nylon bundles of 5.48 and 1.85 grams and of the six cigarettes, as well as the 11 plant seeds and the ashes within the round, dark red seed corresponded to the drug Cannabis Sativa L. The aforementioned known as the marijuana plant with a gross net weight of 65.25 grams, as far as the urine sample of the accused RISCART MUSTELIER, the presence of marijuana and its metabolites were detected and proven, thus it was also proven that in the nylon bundle of 0.52 grams, the presence of marijuana, cocaine, or their metabolites were not detected. That marijuana is currently found subject to international oversight in lists I and IV of the Unique Convention of Narcotic Substances of 1961, of which Cuba is a signing member. That the samples of marijuana together with their wrappings were remitted to the drug depository of the Criminalistics Investigation Division situated at 100 and Aldabo, Boyeros, posteriorly proceeding to their incineration.

The accused, HECTOR RISCART MUSTELIER, 40 years old, Cuban citizen, son of Antonio and Caridad, born in Havana and residing at 471 Subirana Street, Apt. 2, between Manglar and St. Martha, Central Havana, Havana, was known to currently reside at the residence of his spouse, citizen Zurayma Janero Damasco resident of 363 San Joaquin, first floor, between Calzada de Monte and Omoa, Cerro, where he maintains good relations with the neighbors, participates sporadically in CDR* activities, was typically reserved, is currently linked to the musical reggae group HERENCIA, which in the final months of 2011 his lifestyle level has risen considerably noting the purchase of home appliances in his living quarters and in his dress, gets together with individuals of dismal social conduct, of which many are drug traffickers. There is proof of penal antecedents judicially sanctioned in cause 118/2004 of the Popular Provincial Tribune of Havana, for a crime of Production, Sale, Demand, Trafficking, Distribution and Illicit Possession of Drugs, Narcotics, Psychotropic Substances, and others of similar effects thereby sanctioning to two years of deprivation of freedom which he left extinguished on February 12, 2005.

SECOND: That the aforementioned acts constitute a crime of PRODUCTION, SALE, DEMAND, TRAFFIC, DISTRIBUTION AND POSSESSION OF ILLICIT DRUGS, NARCOTICS, PSYCHOTROPIC SUBSTANCES AND OTHERS OF SIMILAR EFFECTS, planned and sanctioned in article 109.1a) of the Penal Code and a crime of RESISTANCE predicted and sanctioned in article 143.1 of the Penal Code.

THIRD: That the accused are responsible in conception of authors of the crime charged by direct execution according to that established in article 18.1 and 2a) of the Penal Code.

FOURTH: That sufficient circumstances of the penal responsibility established in article 55.1.3.a) of the Penal Code combine.

FIFTH: That the sentence to be imposed upon the accused Hector Riscart Mustelier for the crime of PRODUCTION, SALE, DEMAND, TRAFFIC, DISTRIBUTION AND POSSESSION OF ILLICIT DRUGS, NARCOTICS, PSYCHOTROPIC SUBSTANCES AND OTHERS OF SIMILAR EFFECTS is that of TEN YEARS OF DEPRIVATION OF FREEDOM, and for the crime of RESISTANCE is that of ONE YEAR OF DEPRIVATION OF FREEDOM, for a single and joint sentence of TEN YEARS OF DEPRIVATION OF FREEDOM in accordance with the aforementioned 56.1.b) of the Penal Code and the accessory sentence of Deprivation of rights foreseen in Article 37.1.2 of the Penal Code.

CIVIL RESPONSIBILITY: Not required.

OTHERS: The proofs upon which the Public Prosecutor hopes to rest are as follows: A.) Declaration of the accused, if he so agrees. B.) Documentation in folio: 20: Record of possession of sample of urine of citizen Zenen Mario Abreu Peña; 27: Resolution of entry or Search in the home of the accused with negative results; 34: Record of delivery of the black bag with handle which contained in it’s interior a black, Parker brand DVD to the mother of the accused; 37: Record of possession of the two white, transparent nylon bags confiscated with all their contents aforementioned; 38: Record of having sealed the two white, transparent nylon bags taken into possession with all of their contents aforementioned; 39 through 42: Illustrative photo-board of the two white, transparent nylon bags confiscated with all of their aforementioned contents and of the accused wearing his turban; 43: Record of possession of a urine sample of the accused; 44 and 46 through 47: Investigation of accused’s person on behalf of the Territorial Antidrug Unit of San Miguel del Padron; 45: Report of the investigation of the accused’s person on behalf of the Territorial Antidrug Unit of Central Havana; 49 through 50: Penal antecedents of the accused; 52: Certificate of cause 118/2004 of the TPP of Havana; 55 through 58: Expert Chemical-Criminal Drug Report; 59: Report of incineration of drugs. C.) Accompanying testimony report according to list of eyewitnesses to declare upon the facts. D.) Expert report consisting of the experts Yosmel Fernandez Valdez and Milagros Rodriguez Igarza, located at Central Criminal Laboratory on Zulueta between Tte Rey and Dragones, Old Havana, Havana, regarding analyses carried out on the confiscated drug, quantity, results of analyses and other facts of interest.

2. – Ernesto Martinez Ramirez (F-7 to 10), official contacted at the Police Department located at Cuba and Chacon Street, Habana Vieja, Havana, to declare about his whereabouts the day and hour of the occurrences, from the time he was found controlling the accused Angel Laguen, for what motives, what information he had, who offered it to him, when he proceeded to his detention, under what circumstances, what was confiscated from the accused, where it was being carried, how he behaved upon being detained, if the accused admitted ownership of the confiscated drug, if he knew that the accused were controlled by the antidrug department, to what he was dedicated, other data of interest.

5.- Zenén Mario Abreu Peña (F-16 to 19), eyewitness, reachable at San Joaquin Street no. 378 between Monte and Omoa, Cerro, Havana, to declare about his whereabouts the day and hour of the occurrences, how the defendant behaved at the time of arrest, if he had used marijuana the day of the incident, if the accused admitted ownership of the confiscated drug, other data of interest.

6.- Yoandrys Solón Hidalgo (F-23-24), the DNA Operating Officer, reachable at 247 Street Building 17 Apt 24 between 242 and 244, Abel Santamaría, Boyeros, Havana, to declare where he was the day and time of the occurences, what information he had of the accused, if he was controlled by them, from what date, what he did, if he involved in the arrest of the accused, specifically where dealt drugs, other data of interest.

Carromero’s Flesh

The phase of foul play against the exterminating Angel of the youth wing of Spain’s Ruling People’s Party will be tomorrow, October 5th, 2012

It’s rumored that his interrogators, in imitation of King Juan Carlos facing some babbling idiocy from Chavez, have forced him to remain silent and not make a fuss: “Angel, why don’t you shut up already?!”

Before Carromero and After Carromero

Anything he says will be used against him. His biography itself accuses him: speeder with dozens of fines, entangled in matters of finance, twitterer in favor of the cuts of the Spanish government while dancing drunkenly in Seville.

Angel Carromero, in addition to being a member of a party considered fascist in Cuba (in imitation of Comandante Hugo Chavez), had his 15 minutes of infamy this first Friday of October, when he was condemned in a brief trial (according to the dictates of our Foreign Minister), where no Cuban demands anything at all from this Iberian.

It doesn’t stop drizzling in Havana lately. After the flood of more than a hundred thousand hours with Fidel, the Socialist State is mired in its transition to a Chinese-esque capitalism light, where the only thing that won’t fit well are the rights of the Cuban people, on the Island as well as in the Exile. And Angel Carromero will be a key piece in this unlikely vaudeville against all and for the evil of all. Although the coquettish prisoner from Spain’s People’s Party doesn’t imagine it on his Cuban Communist scaffold.

Only a foreign “enemy” fully immersed in “subversive activity” within the Island could be a pretext for the violent death of Oswaldo Paya Sardinas. A death announced for years by paramilitaries, even in front of his own family (and foreigners, to openly disseminate the terror of such an exemplary punishment). Well then, promise kept. There are things that the Castro regime doesn’t play with. Things about which the Castro regime never lied. Those who lack the revolutionary genes to assimilate this sinister sincerity, we don’t want them, we don’t need them…

That fateful Sunday of July 22, hours after the impact and the text message in Swedish heatedly typed after the harassment, in a hospital in the provinces and without evidence of urgent intensive care, another pillar of the Christian Liberation Movement also died, Harold Cepero Escalante, who survived the crash conscious but it didn’t occur to anyone to take a declaration from him (or to allow his family to see him before he died).

Much less do we know the testimony of the ambulance attendants, forensic doctors, and the security personnel who, within minutes, seized this stretch of highway and the city of Bayamo (who alerted them that the ID card of the dead-on-impact read: Oswaldo Paya Sardinas, putative president of post-Castro Cuba?). Only some half-literate peasants declared with precision on Cuban TV that the death car was traveling at a rate of speed of more than 60 mph: “a tin can…”

That dawn, as Oswaldo Paya Sardinas left home without saying goodbye to his wife Ofelia Acevedo Maura, the apocryphal Twitterer @Yoahandry8787 had already revealed in real time his trip to the interior of the country, misrepresenting that it was an excursion to the beach in Varadero. Indeed, nearly a decade before, in the official book “The Dissidents,” we could enjoy some photos violating the privacy of the vacationing Paya-Acevedo family.

There, a teenager of 14 appears to look into an empty future while her father dives and disappears under the grayness of the sea. It was Rosa Maria. It is Rosa Maria, suddenly become, today, the new leader of the Christian Liberation Movement (MLC), the principal moral voice of recrimination against all the violence of the State that corralled her citizen father from the time she was born. Rosa Maria Paya Acevedo, accused before she opened her mouth of meeting false foreign tourists at the edge of the sea for a handful of euros, to fund the youth wing of the MLC.

Not one of the loved ones of Oswaldo Paya Sardinas or Harold Cepero Escalante is accusing the exterminating angel of the New Generations of the People’s Party. The State enterprise that owns the Hyundai Accent with license plate T311402 has not publicly demanded compensation for a single screw of its vehicle. Nor has any rice or forest cooperative spoken out in defense of the crops mowed down by the scars of the homicidal tree. It is a case, then, where legally no one is affected, except governmental innocence.

After the videoclip presented to the press, where a young Spanish politician asks the world not to politicize his case (filmed by the political police, but that’s a circumstantial detail), we already know Angel Carromero’s worst enemy will not be the Cuban State, but the drugged panic of Angel Carromero himself.

At the right hand of his steering wheel, like a perverse character of Perrault or the Brothers Grimm, a Social Democratic Swede snored through the nightmare under the midday sun on a pavement under repairs and a slamming on of the brakes at top speed. According to his testimony and with “European soil under his feet,” and despite his dreamlike innocence, Jens Aron Modig was also taken prisoner and held incommunicado in a windowless room, where his interrogators offended him with impunity, until they coerced him to testify against himself on camera.

From Kafka we know that justice in totalitarian systems is never interested in the Truth, this bourgeois prejudice of the Gospels.  Much less in Life, this bizarre statistic. Angel Carromero, the talking cadaver, like the American Alan Gross, and countless Cubans who have been through the experience, declared like a ventriloquist that he still holds out a certain hope that he will come out safely. It’s called self-preservation and is a symptom of the mediocrity with which the old Europe of the 21st Century throws a tantrum.

In extreme situations, democracy is only for oneself. Western Christianity, then, has no neighbors. Angel Carromero wants to be Angel Carromero, even though he’s sunk in a concentration camp or humiliated in the cemetery where two human beings were plunged and disappeared under the grayness of the Sea.

The drizzle will not stop these days in Havana, before Castro and after Carromero. When this Friday the 5th what we all know and don’t know how to pronounce is finally verified, a new Cuban era in the history of the Revolution will commence. We will all be more alone, more desolate, more exposed to the paparazzi lenses that pornographically exposed his family and later expired Oswaldo Paya Sardinas.

As in the foundational good times of a cynical more than civic war, we will go quietly to survive under the obscene downpour. The free exile will be a million euros farther away than now. The pro-human rights solidarity activists will prefer to operate in any other corner of the world. The Chinese scribbles and the squeal of this collectivist language will make a little more sense to our individualistic sensibilities. The unethical etymology of the word “disappeared” will suffer a terrible updating. In a small air-conditioned room in eastern Cuba, the year zero of the Carromero cosmology is about to begin. Praise be.

Next to Last Month

Have you ever wondered why all the windows in Heaven were broken? Does anyone know if this wandering Earth will be found? Where the night is long. Where oblivion doesn’t hurt. And the digital tic toc of dawn. And the date, odd. Day 29, month 11, me 1.

It begins to snow in the secret heart of Europe. Celestial milk, snowflakes from God, wheat without more meaning than its physical characteristics, hyperreal. We are alive, now. It will be distressing to not be so later. Heaven and Hell are two enormous punishments for those that have been born on Earth and love their counterparts in History,

I don’t want to share anything with millions of souls pure or putrefied. I want the bodies that I loved. I want the conversations that I could and could not translate with our poor language, so silent, so Cuban. I want the brilliance of corneas, not an aura of salvation. I want the touch of fingertips. I will everyone, a lot. I will miss you a lot. It’s perfect.

Everything is late. Everything happens yesterday. We don’t know how to live in the present. This is also perfect.

It’s an explosion. Life is less than a dream, but much more intense for that same reason: life might be the ephemeral instant in which it seems we are either exhausted or ready to wake up. Then, in our sleep or in our wakefulness, life is what happened to you while you are busy doing other things.

We are in the second to last day of the second to last month and this is the second to last line, even though it is only for imitation.

I have a lot more to add but now I realize how perfect it would be to know how to shut it all up once more.

A DEER IN CHAINS

The shortest monologue in the world has just been presented in a small room in Havana: “And where did Cuba end up?” (It is at the level of the short story “The Dinosaur” by the Guatemalan Augusto Monterroso.)

Its name is Rhapsody for the Mule, and it is directed by Nelda Castillo for her theater group The Enchanted Deer.

A heptalogy of madness, directly from the trash, collage over a bare wagon-cart for a collector of homeland waste (a trash collector of revolutionary residues: the actress Mariela Brito walking her brutish biology, drooling and urinating in circles on the stage, excited under the crude lights, its male-female sex only barely disguised under the coagulated dirt of silent desperation).

Go, beast. (“Horse horse,” here crackles the memory of a poem by Juan Carlos Flores.) An invitation to rape. To vomit. To live that which is evil (but without a trace of vaudeville, please: we’re speaking of an incredible hyper-realistic mirror). Push, sweat, give birth to nothing, abort almost an hour of underworld snorts, turn around. Turn a harness inside out.

The Havanothing or Satan Clara: cynical cities unrecognizable in a minimal set with background noise from Radio Encyclopedia, a station that incarnated better than Cuban TV’s Roundtables the discreet charm of the proletariat.

Rhapsody or, rather, Rhapsodium for domesticated animals of the contemporary Cuban street. Not necessarily the megametaphorical mule of José Lezama Lima with that “sure step (…) into the abyss” under a “load of lead,” although “glassy, short-sighted,” moving its “portable lamp (…) of some horror or another” on his “four feet.”

Quadriplegia. Much less would be that enchanted nineteenth deer that would be the delight the Historian of the City. No. The romance has fallen by its own weight before the idiocy (and who knows if the ideology). Memory is factual here. Dirty nouns tossed in a Tareco Plan of the XXI century: family, faith, future, fidelity. Be cultured to be crappy. Cuba fits into any pot.

It stinks. And yet, it hurts you. This song of the wounded invokes some of the most beautiful images that will be remembered over the noisy rhetoric of the Revolution in the year, say, 2059.

Extirpated from the work Galiano Varieties of the group itself, this micro-mispronounced-monologue (the character is very probably missing teeth), deeply moves a corner of El Vedado in a packed room over the last weeks. Every mise-en-scene of The Enchanted Deer leaves the same fear in the chest, this other impossible to translate into words, an ill-defined unease of farewell. Something ends here every night, although we still don’t know how to say what.
